FINE ART INSURANCE CLAIMS

Fine art. A claim built around the work.

A painting is not a generic contents line item. Its materials, condition, history and insurance terms can all affect the claim.

Understand what the policy measures.

Start with how the artwork is insured. An agreed-value schedule, blanket collection limit and property policy may apply different settlement terms. A partial loss may be treated differently from a total loss. The review needs to connect the actual damaged work to those provisions.

Account for the physical and financial effects.

Conservation findings help explain condition and treatment. Appropriate appraisal evidence can address the relevant value before or after damage and treatment. If the policy recognizes residual loss in value, that question should be supported in its own right.

Not every damaged work sustains measurable diminution, and a restoration decision does not automatically justify payment of the entire scheduled amount.

Recognize the range of fine art.

Paintings, sculpture, works on paper and fine-art photography pose different challenges. A tear in canvas, moisture on paper, a fractured sculpture and damage to a finished surface need object-specific assessment. Frames, pairs and sets may introduce additional policy questions.

An offer can be a starting point for a closer review.

If you have received an offer, Julio can examine the basis used, what evidence has been considered and which questions remain unresolved. That may involve the valuation standard, the proposed treatment or a supported residual loss in value.

The goal is a claim supported by the policy and the evidence. No recovery or increase is guaranteed.

What representation can bring.

Julio’s agreed services can include reviewing the insurance position, organizing damage and value evidence, preparing the claim, communicating with the insurer and discussing its response with you. He represents the policyholder.
